reviewed by a Court 200 years ago :

In all my years of practicing law I have never seen anyone sentenced by a judge using a 200 year old case as precedent for the judgment. If it does happen it would be a rare exception to the rule. On the other hand, if you live in Talibanistan you WILL be subjected to punishment written 800 years ago by some dudes who lived in caves. :

well the law as it is is mostly assinine and reflective of the interests of the powers that be...church, state and big business.
if precedent is important it is only so because use of it..or referral to precedent fits some need of the current staus quo. nutten about precendent written in stone.
the word itself, precedent means also guide and implies flexibility.
wat hardens and limits is the partisan or sectarian minority interest of the status quo that finds full expression in courts of law.
when ordinary people tek ovah :cheesy: :cheesy: and appoint the judges :yeti: ...or institute a system of judgement that reflects the popular will, we would then have full flexibility in any referral to precedent...not just expression of the biased state aspect in administering 'justice'
the justice system is now a kind of justice-geddon...along with related police and security geddons..to go with all the other geddons around at this time.
Sharia is a geddon too...like Judaism..and enagelist-geddon in the states.
