Garner hits out at CARICOM dissolution proposal

BRIDGETOWN, Barbados, CMC – Barbados Cricket Association president, Joel Garner, has hit out at the CARICOM-commissioned Governance Panel’s controversial recommendation that the West Indies Cricket Board be dissolved.

Garner, the legendary former West Indies fast bowler and a current WICB director, questioned the practicality of the proposed move, contending that all the boards which comprised the regional governing body were legitimate legal entities and therefore, they could not be simply struck down.

“My questions are: is the BCA which was constituted by an act of Parliament in 1933, an illegal entity and my selection as president of the BCA and illegal act?” Garner queried, while speaking at the BCA’s quarterly meeting here Thursday.

“So I have to ask the question: is the GCB (Guyana Cricket Board) an illegal entity? Is the Jamaica Cricket [Association] an illegal entity? Is the Leeward Islands Cricket Association an illegal entity? Is the Windward Islands Cricket Board an illegal entity? Is the TTCB (Trinidad and Tobago Cricket Board) an illegal entity?”

He continued: “If they are so, they have all been

established in countries in which the prime ministers are making noise and they have to tell the public of the region if these entities are illegal, how they were able to remain vibrant for so long.”

In proposing the dissolution of the WICB, the Governance Panel, headed by UWI Cave Hill Principal Eudine Barriteau, also recommended the appointment of an interim board “whose structure and composition will be radically different from the now proven, obsolete governance framework.”

And while CARICOM Heads have embraced the recommendation and resolved to ensure its implementation, the WICB, headed by controversial president Dave Cameron, has rejected it as an “unnecessary and intrusive demand.”

The board also slammed the report as “limited in scope”, arguing that the panel’s investigations had “triggered findings and recommendations … which are not supported by the facts.”

“The dissolution of the Board is simply not a viable legal or practical option and carries a major financial risk which the panel either ignored or was unaware of,” the WICB told CARICOM in a written response earlier this year.

Last month, Trinidad and Tobago Prime Minister Dr Keith Rowley said CARICOM was soliciting legal advice on the “legal position” of West Indies cricket.

The West Indies' cannot survive in the long term, and I have no doubt that more than one of those teams could do well at international level on their own, despite their small populations.

the supreme constitutional authority in the west indies ought to be the elected heads of the territories in executive meeting.

what do they meet about..often about critical regional issues.  they can make initiative to resolve regional issues in general agreement and according to the popular will, as expressed electorally, and in any other legit social mechanism by which the popular will is expressed and becomes know.

there must be some jurisdiction by which the wicb is constituted an regulated by.  the wicb cannot exist in a region, around which regional resources are organized that caries the west indian representative name and in actual fact does represent the west indian people in a long established activity, that has changed with the times buts till according to basic regional changes in the organization of the regions business and the interest of the west indian people.

there is no area of social activity in any nation or region of collective action by nations that can be free of regulation by those nations in collective meeting. none.

yet the general impression is that the wicb is free to do as it pleases without limitation and regulation by any one or any organizational framework at all save possibly the ICC.  that is the impression Skameron that Skameron appears to operate under..that no one and no regional institution can deal with the wicb..that it is a law unto itself.

CARICOM..AND THE ELECTED REGIONAL HEADS OF GOVERNMENT IN GENERAL MEETING MUST HAVE JURISDICTION OVER ALL IN THE REGION..ALL THAT GOES ON. 

IT IS NOT THAT THEY CAN COMMAND AND DISSOLVE ILLEGALLY BUT THEY CAN ASK AN INSTITUTION TO DISSOLVE ITSELF... OR FACE DISSOLUTION FORCED ON THEM IN RESPONSE TO THEIR FAILURE, AND IN REPRESENTATION OF THE WILL OF THE WEST INDIAN PEOPLE WHO CLEARLY WISH TO SEE THE BACK OF THE CURRENT WICB.

IT IS NOT THAT THEY ARE ILLEGALLY CONSTITUTED AS IMPLIED BY GARNER BUT THEY ARE NOT CONSTITUTED FOREVER AND THEY ARE STILL GOVERNED BEYOND THAT BY THEIR NEED TO BE SUCCESSFUL AND NOT DEGENERATE INTO A SATE OF PROLONGED DYSFUNCTION THAT IS BY NO 20 YEARS AND CONTINUING OF ABJECT FAILURE..AND WHAT APPEARS TO BE UNREMITTING WICB CORRUPTION.

the initiative and drive to 'correct' the wicb was generated by wicb behavior and consistent long standing failure.  it is not as if the heads of government was chaffing at their bits to get at the wicb.  it is 21 consecutive years of consistent failure that has generated this initiative to dissolve the wicb and start afresh.

far from warranting Garners silly response there seems t have been the very greatest reluctance to act on the parts of the heads of Caricom..in the face of utter corruption like the collusion between Skameron and Wavel Hinds that achieved the subversion of the labour management process in cricket, setting back that process to the stone age at the serious and reckless disadvantage of the players.

it is in no ones interest that the players were driven to what is actually slave wages in cricket by our  very own cricket administration..a totally counter-productive development

that is what Garner agrees with..what will surely break up west indies cricket more than any other factor...because none of the players will play for the region when it is financially a clear and obvious waste of financial time, of the best part of ones playing life,  to play for the west indies.

I knew Garner was politically conservative but I did not know he was this rabid.  ultimately laws that govern human activity, are at best guidelines in the process of survival, and must be subject to change at will, as experience teaches us differently, teaches what is necessary on the day is crucial not what was written down as law many years previously

it is time to bell this wicb.  as it is constituted, and in its structure on the ground it is inconsistent with the best interest of west indies cricket.  the wicb is now a huge and parasitic bureaucracy that is bleeding the cricket for its means of subsistence at the expense of the players.  the players must be paid pittances to afford the huge and quite unnecessary wicb staff that must be scaled all the way back to real administrative needs... not bureaucracy for bureaucracy sake, to protect the huge salaries of the top officers.

shut up Garner!  you are dead wrong. and I hope whatever administrative cricket direction is realized, that you never become the leader of the west indies cricket admin.  under Garner's leadership we would be no better off than under Skameron..prolly far worse.  Garner reads like he will be the Tony Blair of cricket admin
