Incest, or ‘family ram’, is an issue that persons still dare not talk about openly in Jamaica and it is for this reason that the most vulnerable appear to not be receiving the help they deserve, experts say.

The Sexual Offences Act states that incest is committed by a male or female who willingly has sexual intercourse with another person, knowing that the other person is related by whole blood or half blood.

If a stepfather, however, has intercourse with his underage stepdaughter, it is instead listed as sexual intercourse with a person under 16 or rape.

Jamaica Constabulary Force Statistics and Information Management Unit data covering 2014 to 2018 shows that fewer persons are coming forward to report cases of incest. At the end of 2018, the reported cases had decreased by 58 per cent since 2014 across multiple divisions. Over the period, the total number of cases reported was 182.

According to Deputy Superintendent of Police Samantha Daley, who is in charge of administration at the Investigation of Sexual Offences and Child Abuse (CISOCA), the stigma of being abused by a relative might prevent more victims from coming forward, although most cases are usually reported by the victims themselves.

“Say I am your father and I am having sex with you. You are going to be less likely to report me because I am the one sending you go school and I buy you what you need. I am the breadwinner in the house. So, you have those kinds of situations, but then you have instances where some persons can’t take the situation anymore and just say ‘me no business, if a you a pay this or that, whatever waan happen, happen. This nah go no further’.”

Dr Diane Douglas and Dr Karen Moore, respectively representing the Institute of Gender and Development Studies of the University of the West Indies, St Augustine, and the TT Association of Psychologists, on March 19 testified at a private sitting of the Senate Select Committee on the Sexual Offences (Amendment) Bill 2019.

Committee member Paul Richards asked if there exist any problems of sexual deviance unique to TT.

Douglas said in her experience as a clinician, there exist two problems in TT that she had not heard of in North America, firstly incest and secondly low-intellect adults unaware of boundaries.

“One has to do with communities where incest is seen as the norm, and unfortunately for us in TT we have communities like that.”

She said in those communities an incestuous relationship with a child is seen by some adults as a rite of passage.

“So what happens, some of these children, of course, grow into adults and then continue with the same mindset that it is okay then to be sexual with a minor.”

Moore elaborated on Douglas’s statement that incest is endemic in certain communities.

An Interview with An Incest Advocate

In Feb. 2016, 36-year-old Monica Mares and her 19-year-old son Caleb Peterson of Clovis, N.M., were arrested and charged with incest - a fourth degree felony under state law.

The two were arraigned in April, but remained in custody for breaching a "no-contact order." Originally scheduled for Aug. 25, Mares' trial has been pushed back to late October. She and her son, who is receiving a separate trial, could potentially face a maximum penalty of $5,000 or three years in prison for their offense.

Although hesitant to speak with American media, the two have discussed their relationship in-depth to The Daily Mail.

"I never thought I was crazy for having these feelings because I didn't see her as my mom, it was more like going to a club and meeting a random person. It didn't feel wrong, it felt normal," Peterson, who was given up for adoption as an infant and met his mother for the first time last year, told the U.K. publication. "Honestly I never thought we would get into trouble for our relationship. We were both consenting adults - when it comes down to it. She's adult, I'm adult, I can make my own decisions. I never thought it would blow up into something like this."

The case raises many intriguing - and to some, unsettling - questions about the inherent privacy rights of consenting adults. Indeed, the case has become something of a flashpoint for proponents of "consanguinamory" - what is most commonly referred to, legally, as incest.

Perhaps surprising to some, there is a fairly sizable online contingent of pro-incest activists on the Web. Up until recently, most communities were more or less niche forums for individuals to anonymously discuss their inter-family relationships and "genetic sexual attraction" (or GSA) to their own kin. Many were hardly a step above fetish porn, with users inundating the message boards with lurid yarns instead of discussing the deeper nuances of the lifestyle.

But now there is a growing movement for consanguinamory proponents to "come out of the closet," so to speak, and rally for GSA acceptance. They have names like Lily's Gardener, so named after a popular romance series penned by Diane Rinella that focuses on the exploits of a heroine sexually involved with her brother. Other online communities, such as The Final Manifesto and Full Marriage Equality, wrap incest under a wider umbrella alongside polyamory and same sex relationships as consensual, non-harmful adult activities they argue legislatures have no business governing.

One of the most notable advocacy blogs on the net, simply titled Consanguinamory, is operated by a woman in her 30s in the United Kingdom, who uses the nom de plum "Jane Doe." Recently, Uncommon Journalism interviewed the founder of the site to shine more light on the blossoming pro-consanguinamory movement, outline the goals of pro-GSA acceptance efforts and make her case for why inter-family, consensual adult sexual relations should not only be legalized, but socially accepted a'la the LGBT movement.

Few subjects in psychiatry elicit more profound, visceral, and polarized reactions than incest—the occurrence of sexual behaviors between closely related individuals—behaviors that violate society’s most sacred and guarded taboos. Furthermore, few circumstances confront the psychiatrist with more complex, painful, and potentially problematic clinical dilemmas and challenges than the treatment of the incest victim and/or the management of situations in which incest has been suspected or alleged by one member of a family, and denied, often with both pain and outrage, by the accused and/or other members of that family.

The study of incest as an actual phenomenon rather than as a fantasy is a relatively recent event. In 1975, an authoritative text proclaimed that the incidence of father-daughter incest in the United States was 1 in a million families.1 Crucial contributions by feminist authors and traumatologists rapidly sensitized the profession to the frequency and importance of incest and its association with psychopathology.2-4 By 1986, Russell5 wrote that some form of father-daughter incestuous activity, ranging from minimal to brutal and aggressive, was found in approximately 1 in 20 families that included daughters and their natural fathers, and 1 in 7 families in which daughters resided with a stepfather. By the early 1990s, feminists, traumatologists, and contributors from the emerging study of dissociative disorders were engaged in a vigorous study of incest and the treatment of incest victims.

However, during this time, there emerged a trend of calling into question the recollections of those who reported incestuous abuse, mounting militant defenses of accused perpetrators. The rising number of incest accusations was attributed to faulty practices on the part of therapists who worked with patients who recalled incest, especially if the recollections had been absent from memory for some time and emerged either in the context of therapy or with the patient’s exposure to certain media, books, and practices. Clinicians were accused of suggesting abuse that had never occurred and of causing their patients’ memories to be contaminated with information and/or ideas that had planted erroneous ideas in their minds. Certain books and media were accused of encouraging false reports.

As a result, for over a decade and a half the study and treatment of incest has been under a cloud of suspicion that has impeded the advancement of knowledge about this devastating form of abuse. Scholars have backed away from even using the word, to the point that it has become difficult to research unless one searches under more bland and innocuous terms. Between the overall power of the incest taboo and scholars’ wish to avoid provoking acrimonious reactions to their work, the term “incest” has been receding from the literature.6 Even now, researchers rush to deny the frequency of incestuous abuse and to minimize its reality and the damage it can cause.7,8 However, a careful examination of the literature demonstrates that the arguments that childhood sexual mistreatment is not damaging are seriously flawed.
