CCJ ruling :
"With respect, the notion that Order 60 could either impact interpretation of the Constitution or create a new election regime at variance
with the plain words of the Constitution
is constitutionally unacceptable.โ
The APNU+AFC believes that the Order created a new electoral regime
and as such is not in keeping with the Constitution.
On that basis, it argued that the votes tabulated during the National Recount cannot be used
to declare the results of the General and Regional Elections.
(xii) A Declaration that letters from the Chairman of GECOM on June 13th, July 9th, and July 10th 2020
purporting to direct the Chief Election Officer as to the content of his advice and report under :
Article 177(2)(b) and Section 96(1) of the Representation of the People Act respectively
are unlawful, constitutional, void, and of no effect.
Chief Justice (ag) Roxane George will Wednesday at 10 a.m. hold a first hearing in the case filed in the High Court
seeking to block a declaration of the results of the national vote recount.
The political parties which contested the elections are all expected to turn up in Court
to get the Chief Justice to throw out the case because it flies in the face of very clear directions already set out
by the Caribbean Court of Justice (CCJ).
The case was filed in the High Court just before the 2 p.m. deadline
by which the Chief Elections Officer Keith Lowenfield
was slated to comply with a directive he has been given to produce a report based on the results of the national vote recount.
Suspended from Bar
On the other hand, the other attorney named on the petition, Bonar Mayo Robertson :was suspended by the Virginia State Bar Disciplinary Board
in 2005 in relation to a personal injury case.
Guyana Times received records which showed that Robertson would have divided his clientโs settlement funds
to pay himself, and later failed to notify his client or medical providers that he was holding funds for them.
It was also found that he failed to file suit on her behalf in a timely manner and then failed to terminate the representation properly.
