On March 13, 2009 United States Attorney General Eric Holder issued a statement that the United States had abandoned the Bush administration term "enemy combatant".[sup][15][/sup][sup][16][/sup] The statement said, ""As we work toward developing a new policy to govern detainees, it is essential that we operate in a manner that strengthens our national security, is consistent with our values, and is governed by law." However, various human rights groups noted it as primarily a symbolic act.[sup][17][/sup] The United States continues to hold detainees at the Guantanamo Bay detention camp.

Note the date Counsel...I may be dumb in your derision, but the facts are what i speak to.

But why didn't your 2 right wing loonie toons McCain and Graham call for Holmes to be designated as an enemy combatant since shortly after his arrest no one was certain if he was connected to Al Qaeda?

This is essentially their argument.  That the US gov't should treat the younger Tsarnaev as an enemy combatant at this early stage and if there is no connection to Al Qaeda or the Taliban then try him as a US citizen in civilian courts.

Why this double standard?  Holmes killed more people and as such should have been deemed a greater risk.

If you were astute, you will have noted that Jokar will be tried in civilian court. and he will be summarily executed. According to the law.
