Yes, she should be jailed. She broke the law. It doesn't matter whatever her hateful beliefs are, she has the freedom to believe them and she had the freedom to leave her spot in the government after the law that went against her beliefs was passed. Instead she willfully stayed and denied lawful and morally sound people from partaking in their basic rights as American citizens to get married. Taking away someone's basic human rights in this country should be a jailed offence, it doesn't matter what she believes. Again, she had the freedom to do one of two things, 1) Follow the laws and be decent enough to allow people marriage, or 2) If she felt such anger towards these people, she had every right to leave her job.

Exactly. The government does not take side on religion matters and it is very worrying when such an incident happens when the law is clear.

Jailed Kentucky clerk Kim Davis, who is spending Labor Day weekend in jail for refusing to issue marriage licenses to gay couples, met with her attorney Friday and insisted any licenses issued in her absence are void and “not worth the paper they are written on” because they weren't approved by her. Her attorney, Mat Staver, compared Davis to Martin Luther King Jr. “She’s not going to resign, she's not going to sacrifice her conscience, so she’s doing what Martin Luther King Jr. wrote about in his Letter from the Birmingham Jail, which is to pay the consequences for her decision,” he said.
