No, it's not as simplistic as you put it. These guys are high ranking members of congress. One is a former presidential candidate. If he was president we now know that he would have thrown out the rule of law and due process and pissed on the Constitution in order to appease the most basic element of vigilante justice.
Those right wing loonies know fully well that this accused person has a better chance of an acquittal in civilian courts than at one of those kangaroo military tribunals in Guantanamo.
